NEW CHANGES WITH IMMIGRATION/NUEVOS CAMBIOS CON INMIGRACIÓN – OCTOBER 5, 2020

  1. USCIS fee changes have been enjoined by the courts. Therefore, the fee changes which were originally to take effect on October 2, 2020, will not take place until the court matters have been decided.

  1. USCIS will resume taking public charge documents with the appropriate applications which are filed such as family-based petitions as the injunctions previously held in place have now been lifted. If you have submitted a prior application or will submit an application up until October 13, 2020, without the public charge documents, USCIS announced that you will receive a request for evidence in the future for those documents. If, after October 13, 2020, you do not submit your application with the public charge documentation, it will be rejected.

  1. DACA renewals will now be reduced to one year at a time as the administration hopes to eventually eradicate DACA altogether.

  1. The Department of Homeland Security has proposed new asylum regulations that would completely bar the granting of asylum on the basis of gender. The new regulations would change the definition of persecution. It would also redefine some of the core grounds for asylum claims, including membership in a particular social group, which could have a dire impact on women and LGBTQ persons. In addition, they wish to deny asylum to people who transited through other countries on their way to the United States and be able to deny asylum speakers basic due process and their day in court by allowing immigration judges to decide cases solely on the basis of their written applications. This would severely limit the types of applications that may be made and the ability of people to be able to obtain asylum.

USCIS announced that they will no longer accept adjustment of status applications for those TPS holders who have traveled on advanced parole due to a new matter which came out of the Office of Administrative Appeals. They, however, did state that this would not affect TPS holders who already have relied on their prior practices and are pending adjustment of status currently. They also stated that they will only apply this new rule prospectively to those who traveled on advance parole after the decision on August 20, 2020.

  1. On a positive note, Congress recently passed new legislation allowing USCIS to expand premium processing to be able to cover new immigration categories. Traditionally, USCIS accepts premium processing for specific employment-based applications. With the new legislation, although it is likely premium processing pricing will increase, it will also be more widely available to those petitioners who did not have previous access to it.

En una nota positiva, el Congreso aprobó recientemente una nueva legislación que permite al USCIS expandir el procesamiento premium para poder cubrir nuevas categorías de inmigración. Tradicionalmente, USCIS acepta procesamiento premium para aplicaciones específicas basadas en empleo.
