7.27.20 IMMIGRATION NEWS UPDATES – NOTICIAS NUEVAS DE INMIGRACIÓN

1. Newark Immigration Court will begin limited master hearings on Monday, August 3, 2020. They will supposedly inform everyone by mailing notices if your hearing is to proceed or not. If you have an attorney, please contact them to stay informed. If you do not have an attorney, please call the court and record the call as proof of trying to find out, just in case. The court has been spotty in providing clear information.

2. DACA – As you may know, in mid-June, the Supreme Court, issued their decision on DACA. Specifically, they declared that the way the Trump administration tried to end the DACA program was incorrect and, as such, they need to proceed with accepting new DACA applications. Unfortunately, USCIS has tried to make clear that they will not accept new applications and have been rejecting them despite the Supreme Court’s decision. That was until, on July 17, a Maryland district court judge ordered that the organization has 30 days to update their website and accept the applications. So, as of right now, it seems that USCIS has been placing new applications in a holding pattern.

But, unfortunately, the Trump administration issued a new change in regulations stopping any possibility of new DACA applications yet again, has stopped advanced parole again, and, finally, also limited new DACA renewals to one year.

3. USCIS has pushed back their furlough plan until the end of August where they have stated they will furlough over two-thirds of their staff due to lack of funding. It is unclear, at this point exactly how the furloughs will affect the processing of applications, but we have already seen a significant slow down in processing already, so we can only imagine things will grind to a near halt once the furloughs take place.

4. As a part of the previously mentioned delays with USCIS which are already happening, there is also a current issue with printing both work permits and green cards. After its contract ended with a third-party printing company, USCIS has significantly cut back on printing both green cards and work permits for many, even though the people who are impacted by these delays have already had their applications approved.

5. Changes to asylum work permit processing will take effect at the end of next month. There have been two new rules that were published last month with regard to asylum applicants who wish to apply for work permits. The rules will change who is eligible for work permits and how long it may take to get one.
